These Terms and Conditions (“Terms”) govern your access to and use of the European Collision Center mobile application (the “App”) and related services (together, the “Services”) provided by European Collision Center (“European Collision Center,” “we,” “us,” or “our”).

By creating an account or using the Services, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility and invite-only access

The Services are provided on an invite-only basis. Accounts are created by European Collision Center, and invited users complete setup through an emailed invitation link. The App does not offer public self-registration. You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. You agree that the information you provide is accurate, current, and complete, and that you will keep it up to date.

2. Your account

• You are responsible for keeping your credentials confidential and for all activity under your account.
• Verification (such as one-time codes by SMS or email) may be required to confirm your identity.
• Notify us promptly at info@europeancollision.com if you suspect unauthorized use.
• You may not share, transfer, or assign your account.

3. What the Services do

The Services allow invited customers to submit vehicle details and damage photos, request a vehicle damage estimate, track the status of that request, and view and download estimate documents. The App lets you scan a vehicle barcode or enter a VIN, upload guided photos, add damage and vehicle details, save drafts, and follow your request from submission to completion.

4. Estimates are not binding offers

Estimates and quotes provided through the Services are preliminary and for informational purposes only. They are based on the information and photos you submit and are subject to change following a physical inspection of the vehicle. An estimate does not constitute a binding offer, contract, guarantee of price, guarantee of repair, or an insurance determination. Final pricing, repair scope, and timelines are established separately, in writing, after inspection. European Collision Center is not an insurer and does not provide insurance advice.

5. Your content and license to us

You retain ownership of the photos, documents, and information you submit (“Your Content”). By submitting Your Content, you grant European Collision Center a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, and use Your Content solely to provide, maintain, and improve the Services and to prepare and deliver your estimate.

You represent and warrant that you have the rights necessary to submit Your Content and that it does not infringe the rights of any third party or violate any law. Do not upload content that is unlawful or that depicts or includes anyone or anything you do not have the right to share.

6. Acceptable use

You agree not to:

• use the Services for any unlawful, fraudulent, or unauthorized purpose;
• submit false, misleading, or inaccurate information;
• attempt to gain unauthorized access to the Services, other accounts, or our systems;
• interfere with, disrupt, or overload the Services or connected networks;
• reverse engineer, decompile, or extract source code, except as permitted by law;
• copy, resell, or exploit any part of the Services without our written permission;
• upload viruses, malware, or other harmful code.

7. Intellectual property

The Services, including all software, text, graphics, logos, and design (excluding Your Content), are owned by or licensed to European Collision Center and protected by intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to use the App for its intended purpose. All rights not expressly granted are reserved.

8. Third-party services

The Services rely on third-party providers (including cloud hosting, push-notification, messaging, and vehicle-data services) as described in our Privacy Policy. We are not responsible for the content, policies, or practices of third parties. Your use of any linked third-party service is at your own risk and subject to that provider’s terms.

9. Notifications and communications

By using the Services, you consent to receive service-related communications (verification codes, invitations, status updates) by push, email, or SMS according to your notification settings. Standard message and data rates may apply to SMS. You can manage optional preferences in the App; essential security and verification messages are required while your account is active.

For SMS specifically: European Collision Center sends SMS text messages only to users who opt in during registration. These may include one-time verification codes, estimate-status updates, requests for additional photos or information, and related account notifications. Message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help. SMS consent is not a condition of creating an account or of any purchase. Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties.

10. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or secure, or that vehicle data (including VIN-decoded information from third-party sources) will be accurate or complete.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EUROPEAN COLLISION CENTER AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless European Collision Center and its affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Services, your violation of these Terms, or your violation of any law or third-party right.

13. Suspension and termination

We may suspend or terminate your access at any time if you violate these Terms, if required by law, or to protect the Services or other users. You may stop using the Services and request account deletion at any time by contacting info@europeancollision.com. Sections that by their nature should survive termination (including Sections 4, 5, 7, 10, 11, and 12) will survive.

14. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in San Francisco County, California, for any dispute not subject to arbitration or small-claims resolution, to the extent permitted by law.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above and, where appropriate, notify you in the App or by email. Continued use after an update means you accept the revised Terms.
